Advertising Guidelines

Your help in ensuring top advertising standards is greatly appreciated! Click here to report a possible violation of the policy presented below.

CyberDefender believes that advertising and marketing on the Internet should reflect the highest standards of ethical conduct. As such, all Agency/Network and Agency's Publishers (collectively "Publisher") must abide by the following advertising and marketing guidelines ("Guidelines") in buying media for CyberDefender's software and services ("Product").

The ad creative (pop-under, email, banner, etc.) or the landing page must not:
  • Mislead the consumer as to the source of the advertisement.
  • Create the association or impression of a Spyware plant in conjunction with the Product.
  • Bundle the Product with other malicious software, including but not limited to software containing Spyware, trojans, backdoors, viruses, and/or adware.
  • Present and deliver the Product without the consumer's permission using for example 'Terms and Conditions' or 'opt-in' by consumer such as fly-by icon drops or placement on the consumer's desktop applications/toolbars.
  • Utilize SPAM emails which are not compliant with the most recent version of the CAN-SPAM guidelines.
  • Utilize 'mouse trapping' whereby the advertiser does not allow the consumer to use their 'back button' and traps them on their site.
  • Imitate presupposed knowledge about the functionality of the consumer's personal computer.
  • Pretend to know details about a consumer's computer/system, including what is/is not installed, whether it has discovered viruses, worms, corrupted files, etc. (i.e. scare tactics to make users buy/download software etc.)
  • Promote or contain viruses, worms, corrupted files, cracks or other material that is intended to or may damage or render inoperable software, hardware or security measures of the consumer or any third party.
  • Have a Pop-Up ad or a Pop-Under ad launched from within an ad or from the landing page whether real or imitated behavior.
  • Perform an automatic download of anything to a customer's system or present a download dialog box without first presenting detailed information to the customer about the download and then requiring the customer to click to download the product.
  • Employ any other marketing practice which may impair the reputation of CyberDefender or the Product.

The following advertising practices are not permitted in connection with the Product:
  • Content that facilitates and/or promotes, whether directly or indirectly, the sale or use of software whose purpose is to collect demographic and usage information from a consumer's computer without their express consent.
  • Content that facilitates and/or promotes, whether directly or indirectly, the sale or use of software that 'sneaks' onto a user's system and performs activities hidden to the customer or user.
  • Content that facilitates and/or promotes, whether directly or indirectly, the sale or use of software that are bundled as hidden components of other software whether free or for fee.
  • Content that facilitates and/or promotes, whether directly or indirectly, the sale or use of software that in any way alter, harm, disable or replace any software installed on a consumer's or user's computer without their express consent.
  • Automatic downloads.
  • Presentation of download dialog boxes without a consumer's express action (click) to perform a download.

In lead generation marketing, each offer presented to users accessing advertisement in connection with the Product must:
  • Clearly disclose the CyberDefender name.
  • Include a conspicuous opt-in specific to the offer.
  • Provide an opt-out for promotional communication, including an opt-out for each follow-up promotional communication.
  • Provide an obvious and direct link to CyberDefender's privacy policy.
  • The offer requirements and limitations must be presented in a clear, conspicuous manner prior to asking customers to provide any Personally Identifiable Information (PII).
  • The offers of the Product presented as part of a single advertising experience must be of a 'reasonable' number (i.e. 5 separate pages with multiple offers does not constitute reasonable)

CyberDefender will monitor forums, message boards, search engines, feedback from ISPs, customer complaints, and other means for signs of marketing activity by resellers that violate these Guidelines in connection with the Product and which wend can trace back from the affiliates tracking links and IDs. If activity violating these Guidelines has been identified, then CyberDefender shall have the right to take any of the following actions including but not limited to termination of the Agreement between CyberDefender and the Publisher:
  • CyberDefender will notify the Publisher with a cease and desist email or phone call of the deceptive marketing practice that violates these Guidelines ("Notice of Violation"). Upon receipt of the Notice of Violation from CyberDefender, the Publisher shall identify and report to CyberDefender the Agent responsible for the violation of these Guidelines including a detailed description of how the Agent presented CyberDefender's Product offer(s).
  • Upon receipt of a Notice of Violation, the Publisher must immediately notify the agent to remove the Product from sale by the agent and ensure that the Agent complies in removing CyberDefender's Product from their website
  • Any breach of these Guidelines shall be a material breach of the Agreement between the parties. If Publisher deviates from these Guidelines, then CyberDefender in its sole discretion may withhold payment to the Publisher and its Agent for advertising or marketing involving the Product.
